Welcome to Kanecorp. These Terms of Use (" Terms") govern access to and use of the website, platform and services provided by Kanecorp (" Kanecorp", "we"). By accessing or using our services, you represent that you have read, understood and agree to be bound by these Terms. If you do not agree with any provision, we recommend that you stop using the platform and the website.

1. Scope and Purpose

These Terms apply to the kanecorp.solutions website, its official subpages and the Kanecorp platform, including solutions made available in a Software as a Service (SaaS) model.

The Kanecorp platform provides corporate solutions for management, operational analysis, logistics and data processing in high-criticality environments. It may be used in corporate, institutional and governmental contexts, as described on our website, commercial proposals and specific agreements.

In the event of any conflict between these Terms and a specific agreement executed between Kanecorp and a customer, the provisions of the specific agreement shall prevail with respect to the relationship governed therein.

2. Eligibility and Access

Access to the platform may be granted to companies, governmental institutions, military units, partner entities or other authorized customers, always based on a contract, agreement or formal authorization issued by Kanecorp.

End users (such as employees, operators or managers) are linked to the contracting customer and must use the platform strictly within the profiles and permissions defined for them.

Users are responsible for keeping their access credentials (username, password, tokens, keys or equivalent authentication mechanisms) confidential. Any action performed using such credentials will be presumed to have been carried out by the user or by someone duly authorized by the user.

In case of suspected misuse, loss, theft or unauthorized access to an account, the user and/or the contracting customer must immediately notify Kanecorp through official support channels.

3. Acceptable Use and Prohibited Uses

The Kanecorp platform and website must be used exclusively for institutional, operational or management purposes related to the activities of the contracting customer, as set out in the contract or formal authorization. Without prejudice to other contractual or legal obligations, you may not:

• Use the platform for purposes other than those provided for in the applicable contract or in violation of applicable law or regulation.
• Breach, bypass or attempt to compromise any Kanecorp security, authentication or access control mechanism, including unauthorized penetration testing, reverse engineering, vulnerability scanning or exploitation of flaws.
• Access, attempt to access or manipulate data of third parties, other customers or environments for which the user does not have explicit permission.
• Copy, reproduce, adapt, translate, modify, create derivative works from, sublicense, sell, resell or otherwise exploit the platform, in whole or in part, without Kanecorp's prior express authorization.
• Publish, send, process or store unlawful, offensive, discriminatory or defamatory content, or content that infringes third-party rights, including intellectual property or privacy rights.
• Use the platform to send spam, conduct malicious campaigns, spread malware, engage in phishing or any activity that may compromise the security of systems or data.

Kanecorp may, at its discretion and as provided for in the applicable contract and legislation, suspend or restrict access in case of misuse, security risk or violation of these Terms.

4. Intellectual Property

All rights in and to the platform, website, source code, algorithms, models, interfaces, layouts, texts, trademarks, logos, domains, documents, technical materials and related content are the exclusive property of Kanecorp or its licensors, and are protected by intellectual property laws and other applicable regulations.

Use of the platform or website does not grant or transfer any intellectual property rights. Only a limited, non-exclusive, non-transferable right of use is granted, subject to compliance with these Terms and applicable contracts.

Reproduction, distribution, modification, reverse engineering, decompilation or any form of unauthorized technical or economic exploitation is strictly prohibited and may result in civil and criminal liability.

5. Privacy and Data

The processing of personal data and corporate data within the Kanecorp platform follows strict security, governance and compliance standards, in line with applicable data protection laws and sector-specific regulations.

Rules regarding collection, use, sharing, retention and data subject rights are detailed in our Privacy Policy , which is hereby incorporated by reference into these Terms.

Each customer is responsible for using the platform in accordance with its own internal information security, confidentiality and data protection policies, as well as for instructing its users on the proper use of the resources made available.

6. Disclaimers and Limitation of Liability

The platform and website are provided "as is". Kanecorp applies industry best practices for security, monitoring and availability, but does not warrant the complete absence of failures, interruptions, delays or errors.

To the maximum extent permitted by applicable law, Kanecorp shall not be liable for:

• indirect, incidental, special, punitive or consequential damages, or lost profits, arising from the use or inability to use the platform or website;
• failures, unavailability or issues caused by infrastructure external to the service (such as telecommunications networks, internet providers, third-party data centers or customer equipment);
• misuse of the platform by users, including unauthorized sharing of information, breaches of the customer's internal policies or non-compliance with applicable laws.

Specific limitations and liability provisions may be defined in agreements entered into with each customer, and such provisions shall prevail over this clause where more detailed or specific.

7. Changes to These Terms

Kanecorp may update these Terms at any time to reflect changes to the platform, legal or regulatory updates or business adjustments. Whenever there is a material change, the new version will be published on this page with the corresponding "Last updated" date.

Your continued use of the platform or website after the revised Terms are published will be deemed acceptance of the new Terms, unless otherwise provided in a specific agreement.
